A QDRO, Qualified Domestic Relation Order, is pre-tax division of a 401K, IRA or Pension account.
The distribution is based on the alternate payees community property rights in a participants account. The amount is calculated based on a court ordered formula or the distribution may be based on other factors determined by the court at the time of divorce.
A QDRO cannot be initiated until a Judgment for Dissolution is entered by the court.
