Probate in San Diego is a court-supervised process where a deceased person’s estate is settled. This includes verifying the will (if one exists), identifying and valuing assets, paying debts, and distributing the remaining property to beneficiaries. If there is no will, the estate is distributed according to California’s intestate succession laws.

Certain estate planning strategies can prevent assets from going through probate. Setting up a living trust, adding payable-on-death designations to financial accounts, holding property jointly with survivorship rights, and assigning beneficiaries to life insurance or retirement accounts allow assets to pass directly to heirs without court involvement.

Not all estates require full probate court proceedings. Smaller estates may qualify for a simplified process, such as a small estate affidavit, which avoids lengthy court proceedings. If the estate consists mainly of assets that transfer outside probate, such as those in a trust or with designated beneficiaries, probate court may not be necessary.

To begin probate, a petition must be filed with the San Diego County Superior Court. Required documents include the original will (if available), a death certificate, an inventory of assets, and a list of outstanding debts. Notices must be sent to heirs, beneficiaries, and creditors. The appointed executor or administrator is responsible for following court procedures, settling obligations, and distributing assets.

When probate is required but not filed, assets remain in limbo, preventing heirs from taking legal ownership. Creditors may also pursue claims against the estate. If a will names an executor and they fail to act, the court may appoint another person to handle the estate. Delaying probate can lead to legal complications and potential penalties.

Timelines vary based on estate complexity, potential disputes, and court scheduling. Some cases are completed within a few months, while others extend beyond a year, especially if there are legal challenges or delays in asset liquidation.

Assets owned solely by the deceased without designated beneficiaries typically go through probate. This includes individually owned real estate, bank accounts, investment accounts, business interests, and valuable personal property such as vehicles, jewelry, and artwork. Assets held in a trust, jointly owned property with rights of survivorship, and accounts with named beneficiaries bypass probate.
