About Child Custody

Child Custody is a legal term used to describe the legal and practical relationship between a parent or guardian and a child in that person’s care, such as the right to make decisions on behalf of a child and the duty to care for and support the child.

Residence and contact issues typically arise in proceedings involving divorce. In most jurisdictions the issue of which parent the child will reside with is determined in accordance with the best interests of the child.

Physical Child Custody

Physical custody involves the day-to-day care of a child and establishes where a child will live. If a parent has physical custody of a child, that parent’s home will normally be the legal residence of the minor child.

In custody cases, the schedule for which parent provides lodging and care for the child is defined by a court-ordered custody schedule (also known as a “parenting plan” or “parenting schedule”).

Paternity is a court action to determine legal custody, physical custody or child support for a child which was born to parents who were never married to each other.

Child Custody Orders can be obtained as part of a Paternity or Divorce action. The type of action is determined by whether the child’s parents were married to each other or not.

Joint physical custody involves a court order that awards custody of a child to both parties.

In joint custody, both parents are custodial parents and neither parent is a non-custodial parent; in other words, the child has two custodial parents.

Legal Child Custody

Legal custody involves the division of rights between the parents to make important life decisions relating to their minor children.

Legal custody may be joint, in which case both parents share decision-making rights, or sole, in which case one parent is vested with the rights to make those key decisions without regard to the contrary wishes of other other parent.

We offer three options for our Child Custody service.

Involvement Throughout the Process

For our full involvement throughout the custody process, the cost is $1,500 up front then $500/month until the custody is finalized or our office is no longer involved. You will receive full assistance with all paperwork and Ellie’s excellent mediation services.

Filing of a Stipulation

The cost to prepare a Stipulation is $1,500. This can be done to modify an existing order. Both parties must ultimately sign this Stipulation for it to become an order. One hour of mediation is included.

Filing of a Motion

The cost to prepare a Motion is $1,500 plus the court filing fee. After the motion is filed, the non-filing party will be served and our service is complete.
