Did you know that Laguna Legal specializes in making sure your client’s property taxes don’t get reassessed as a result of property title transfers.  We have been helping clients avoid reassessments since 1998.

Here are some tips that you should follow:

1) Always use a PCOR and make sure you mark the check boxes on page 1 with as many “yes” as you can.  The more yesses, the less chance of reassessment!

2) Make sure to study and use the proper R&T Codes.  A properly coded deed will help avoid property tax reassessment.

3) If a property is being transferred from an individual to an LLC, make sure the members of the LLC are the same members as the transferrer.  If a husband and wife are on title, then a husband and wife should both be on the LLC.

4) Multiple steps are helpful to avoid reassessment.  In the example above, if only husband is the member of the LLC, then the first step would be to record an Interspousal Transfer Deed removing wife from title, then the second step would be transferring the property from only husband to his LLC.  This two step process will insure that your property taxes are not reassessed.
